1. Introduction

The Town of Boothbay, Maine is soliciting proposals from qualified law firms to provide comprehensive legal services as the Town’s municipal legal counsel. The selected firm will represent the Town in a variety of legal matters and provide advice to the Select Board, Town Manager, and municipal departments.

This RFP outlines the scope of services required, minimum qualifications, submission requirements, and evaluation criteria.


2. Background

Boothbay is a coastal town in Lincoln County, Maine, known for its maritime heritage, tourism, and natural beauty. The town is governed by a five-member Select Board and operates under a Town Manager form of government.

Legal services are essential for supporting municipal operations, ensuring compliance with state and federal laws, managing risk, and guiding the Town in policy and decision-making.


3. Scope of Services

The selected firm will provide legal counsel including, but not limited to:

  • General municipal law and statutory interpretation
  • Attendance at Select Board meetings as requested
  • Drafting and reviewing ordinances, policies, contracts, and other legal documents
  • Representation in civil litigation and administrative proceedings
  • Land use, zoning, planning, and code enforcement matters
  • Public records and open meeting law compliance
  • Labor and employment matters
  • Real estate and property matters
  • Risk management and insurance-related issues
  • Taxation and municipal finance, including bonds and assessments
  • Legal updates and training for staff and elected officials

4. Qualifications

Firms must demonstrate:

  • Experience representing Maine municipalities
  • Knowledge of Maine municipal law and procedures
  • Experience in litigation and administrative hearings
  • Ability to respond promptly to legal inquiries
  • A designated lead attorney with at least 5 years of municipal experience
  • Malpractice insurance coverage

5. Proposal Requirements

Proposals must include:

  • Cover Letter introducing the firm and interest in representing Boothbay
  • Firm Overview including history, size, and office location(s)
  • Team Information with bios of attorneys who would serve the Town
  • Relevant Experience in municipal law and Maine clients served
  • Approach to Service including availability, communication methods, and philosophy
  • Fee Schedule including hourly rates or proposed retainer models
  • References from at least three municipalities served
  • Proof of Insurance

7. Evaluation Criteria

  • References and reputation
  • Cost and fee structure

The Town reserves the right to reject any or all proposals, to waive informalities, and to select the firm that best serves the interests of the Town.
